A payment claim under s 17 of the BCIPA need only state the amount the claimant claims to be payable; it need not correctly state the amount payable, and 'payable' does not mean 'due and payable'. Non-compliance with the s 17(4) service period does not invalidate a payment claim. However, non-compliance with the s 21(2) notice requirements (including timing) would render an adjudication application a nullity, as the words 'cannot be made' should be given their natural meaning. Contractual payment terms providing for payment later than 15 business days after submission of a payment claim are void under s 67W QBSAA where the contract is a commercial building contract, causing the due date to fall under s 15(1)(b) of the BCIPA.
