A s 12A warning under the Evidence Act 1929 (SA) cannot be given unless a party requests it; the trial judge is not required to invite such a request. A Bromley-type warning directing the jury to scrutinise the evidence of a complainant with ADHD with particular care, and to be satisfied it is safe to convict only after very close and careful scrutiny, may be adequate without requiring a formal direction that it would be unsafe to convict without corroboration. The s 12A warning and the Bromley warning are not necessarily the same thing.
