Official intervention in the process of drug importation (including seizure by foreign customs officials and subsequent controlled delivery) does not terminate the process of importation or create a 'new importation' for the purposes of the offence of being knowingly concerned in importation under s 233B(1)(d) of the Customs Act 1901 (Cth). Participation at the start and/or end of the importation process is sufficient. Separately, failure to comply with s 16F(1) of the Crimes Act 1914 (Cth) does not render a sentence null and void, particularly where the offender has voluntarily absconded.
