Where defence counsel makes a deliberate forensic decision not to object to technically inadmissible complaint evidence in order to exploit it tactically, the accused cannot later rely on the admission of that evidence as a ground of appeal. A trial judge's failure to relate evidence to issues in the charge, while a deficiency, will not result in a miscarriage of justice in a brief trial where the issues are clear and defence counsel does not seek further directions.
