The disclosure obligations in s 134AB(8) of the Accident Compensation Act 1985 are confined to the 'deemed injury' gateway under s 134AB(7)(a) and do not extend to proceedings commenced via the certificate or leave gateways. Even where disclosure obligations apply, s 134AB(11) renders only the undisclosed material itself inadmissible, not the viva voce testimony of a witness about matters contained in that material. There is no residual judicial discretion to admit evidence rendered inadmissible by s 134AB(11) or to exclude relevant evidence not caught by the prohibition.
