An application for adjournment of a criminal trial must be supported by evidence, not merely assertions from the Bar table. Where an accused has had prior opportunity to prepare a defence and raises inability to prepare only after other adjournment bases have failed, a trial judge is entitled to refuse the adjournment. An appellate court will not interfere with such a refusal unless the discretion has miscarried in the House v The King sense.
