An acquittal on a charge where the actus reus is supported only by circumstantial evidence is not inconsistent with a conviction on a separate charge where the actus reus was conceded, even where the defence on both counts was involuntariness. Cancellation of parole after sentencing does not necessarily require a reduction of sentence on re-sentencing; the nature of the prior offences for which parole was granted and the offender's continued risk factors are relevant to the totality assessment.
