The Court of Appeal held that the jury's acquittal on rape (which necessarily involved a reasonable doubt about consent) was irreconcilable with the conviction for aggravated burglary, because if the complainant was awake and the light was on, there was no basis for finding the elements of trespass or intent to commit an assault upon entry to the bedroom. The conviction for aggravated burglary was quashed and a verdict of acquittal entered. The Crown conceded the inconsistency.
