A Crown submission on sentencing range that baldly states figures without articulating the considerations on which it is based, including reference to current sentencing practices, is unlikely to assist the court and may be productive of error. For trafficking in a non-commercial quantity of cannabis at the lower end of the scale (less than 5% of a commercial quantity), a sentence of seven years' imprisonment is manifestly excessive and unjustifiably disparate from current sentencing practices, even where the offender has a prior trafficking conviction and pleaded not guilty.
