The Court of Appeal's jurisdiction to grant a stay under r 66.16 of the Supreme Court (General Civil Procedure) Rules 2005 (Vic) extends to orders not themselves the subject of appeal, where a set-off against a prospective successful appeal judgment may arise. Where there is a real risk of dissipation of judgment proceeds, a stay conditional on payment into court may be ordered to protect both parties' interests.
