Apparently inconsistent verdicts of conviction and acquittal arising from the same incident may be reconciled where the trial judge's erroneous directions misled the jury into treating non-alternative counts as alternatives, or where the jury exercised legitimate mercy in declining to convict on overlapping charges. Erroneous directions that operate in the accused's favour do not give rise to a miscarriage of justice.
