A serious offence of unlawful wounding committed by use of a glass or bottle will ordinarily result in a significant term of imprisonment to be immediately served; cases where such a term is not imposed will be exceptional. Community expectations are a relevant consideration in sentencing but do not constrain the exercise of sentencing discretion. Courts of summary jurisdiction sentencing for either-way offences should take the statutory maximum penalty as the starting point, not the jurisdictional limit. The relevance of media-related public humiliation as a mitigating factor remains unresolved at the High Court level, but it would be wrong in principle to give it significant weight.
