When a new trustee is appointed by deed in accordance with the trust instrument, the court will order the former trustee to deliver all trust documents, instruments of title and property to the new trustee. Such orders should be made without prejudice to the former trustee's equitable right of indemnity from trust assets for liabilities properly incurred during the trusteeship, which equity recognises as a charge over trust assets.
