When amending pleadings at a late stage, the amending party must provide all necessary particulars within the amendment itself rather than deferring to a subsequent request for particulars. A pleading of breach of duty that fails to identify which of multiple alternative limbs is relied upon, and fails to particularise the facts constituting breach, will be disallowed as too general. However, the reintroduction of a profit-based claim previously maintained and then removed is not necessarily precluded on discretionary grounds where the amendment will not substantially delay trial and the prejudice to the opposing party is limited.
