The term 'uses' in s 147 of the Criminal Property Confiscation Act 2000 (WA) encompasses all conduct that brings property within the definition of 'crime-used' under s 146, including conduct falling within s 146(1)(c) (acts done on property in connection with a confiscation offence). A crime-used property substitution declaration under s 22 is therefore available in respect of all categories of crime-used property, not only property 'used' within the narrower meaning of s 146(1)(a) or (b). The act constituting the 'use' of property under s 146(1)(a) need not be performed with the specific intention of committing the confiscation offence; it suffices if the use has the consequence or effect of facilitating the offence.
