A denial of procedural fairness in the hearing of an amendment application will not result in the order being set aside where the appeal court is satisfied that the proposed amendments are embarrassing, substantially the same as amendments previously disallowed, and made after unexplained delay, such that a rehearing would be futile. The question of the extent to which the right to an oral hearing may be modified (as distinct from denied) was left open.
