To demonstrate exceptional reasons for bail pending appeal under sch 1 pt C cl 4A of the Bail Act 1982 (WA), an appellant must at least demonstrate that the appeal has strong arguable grounds. Mixed verdicts (acquittals on some counts) are a strong indicator that a jury was not influenced by extraneous information introduced by a juror during deliberations. Health problems being adequately managed in prison do not, alone or combined with arguable (but not strongly arguable) grounds, constitute exceptional reasons.
