When assessing whether employment contributed 'in a material degree' to a disease under s 4(1) of the SRC Act, the Tribunal must consider whether the employment was an operative factor that actively brought about the condition, not merely the setting in which a personal relationship developed. The Tribunal must consider all aspects of the employment, including whether workplace proximity facilitated the development of a harmful relationship. A finding that a personal relationship caused the disease does not preclude a finding that the employment also contributed materially to it. The exclusionary provision for failure to obtain a transfer applies even where the employee subsequently obtains the transfer.
