An owners corporation in a residential strata scheme is entitled in its own right to make a single claim under a statutory home warranty insurance policy in respect of defective work on common property, attracting only a single excess, regardless of the number of lots in the scheme. The entitlement flows from the owners corporation's status as registered proprietor and successor in title to the developer, and does not depend on the issue of a certificate of insurance to the owners corporation. The questions whether the $200,000 aggregate cap applies to owners corporation claims for common property, and whether individual lot proprietors can independently claim for common property defects, remain open.
