Conditions on a medical practitioner's registration following a finding of unsatisfactory professional conduct must be proportionate to the finding and limited to the area of practice in which the deficiency was identified. Conditions tantamount to suspension or deregistration cannot be imposed absent a finding of professional misconduct. Where the Commission succeeds on some but not all complaints and particulars, costs should be apportioned accordingly. A practitioner who does not give evidence as to changed practice or intentions cannot resist the imposition of protective conditions on the basis of unsworn submissions.
