A 'building claim' under s 48A of the Home Building Act 1989 (NSW) is not limited to claims for breach of statutory warranty under Part 2C but extends to tort claims arising from a supply of building goods or services, giving the CTTT jurisdiction even where no statutory warranty claim exists against a particular defendant. The statutory warranties under s 18C may not be available against a co-owner spouse who is not the holder of the owner-builder permit, but this does not defeat Tribunal jurisdiction. The operation of s 18C remains unresolved.
