An undertaking to the court to pay any amount found by a court to have been overpaid does not, without more, extend to cover the costs and expenses of the proceedings in which that overpayment was established. Even if such an undertaking is analogous to a guarantee, it engages only with the amount determined by judgment, not the costs of obtaining that judgment. The only costs potentially covered would be those incurred after the court finding, in obtaining the payment promised by the undertaking.
