A finding that a medical practitioner's impairment is 'likely to' detrimentally affect capacity to practise medicine at some indefinite future time does not support a deregistration order under s 64(1)(a) of the Medical Practice Act 1992 (NSW), which requires satisfaction that the practitioner is not presently competent to practise medicine. A tribunal conducting a rehearing must independently consider what orders are appropriate and cannot simply allow a prior deregistration order to stand upon finding complaints proved. The question whether a complaint of impairment (without a separate complaint of lack of competence) can support a deregistration order was left open.
