An application for leave to appeal will not be summarily dismissed where documentary evidence arguably supports the appellant's case and the primary judge's reasons did not adequately address that documentary material, even where the primary judge made adverse credit findings. A stay of a writ of possession will be lifted where the value of the security is substantially less than the debt, the borrower has made no payments for an extended period, liability for the principal is not in dispute, and the borrower does not contend the appeal would be nugatory without a stay.
