A judge of the Supreme Court has no duty to answer questions from a litigant about the judge's religion, beliefs, or membership of organisations, and the refusal to answer such questions cannot give rise to a reasonable apprehension of bias. The Supreme Court and its judges exercising the Court's jurisdiction are immune from judicial review by way of prohibition. Fitness for judicial office is not a matter to be tried in court proceedings; the appropriate mechanism is the Judicial Officers Act 1986 (NSW), s 15.
