The Hore-Lacey defence of justification (allowing a defendant to plead and justify an alternative imputation comprehended by or a variant of the plaintiff's imputation) is available in all Australian jurisdictions outside NSW. The Polly Peck defence (justifying a 'common sting' linking separate defamatory allegations) is not available in any Australian jurisdiction. Section 18 of the Defamation Act 1957 (Tas) applies to all distinct defamatory charges contained in the publication, not only those raised by the plaintiff.
