Leave to appeal from interlocutory and costs orders under s 57 of the Land and Environment Court Act 1979 (NSW) will be refused where the result of any appeal would be a foregone conclusion. A Court of Appeal has no original jurisdiction to grant relief not litigated below, and a notice of appeal seeking to invoke such jurisdiction is incompetent.
