A defendant is not free to ignore parts of a pleading that do not set out the facts by which the plaintiff contends that particular defendant is liable; where fraud is clearly alleged in the pleading served on a defendant, it need not be separately pleaded in the portion of the statement of claim specific to that defendant. Procedural fairness regarding allegations of dishonesty can be satisfied by notification in pleadings without the allegation being put in cross-examination. There is no special rule entitling solicitors or other professionals to special treatment on applications for leave to appeal merely because a finding of dishonesty has been made against them.
