Where a primary judge fails to deal with an application at all, the proper course is to return to the primary judge rather than appeal. Security for costs against a foreign plaintiff may exceed the ordinary measure of enforcement costs where there is genuine uncertainty about barriers to enforcement, such as the South African Protection of Businesses Act. The Court of Appeal will show great restraint in reviewing interlocutory decisions from the Commercial List.
