For a first offender who pleads guilty to possession of child exploitation material under s 228D of the Criminal Code 1899 (Qld), the sentencing range is six to 18 months imprisonment. A sentence of two years imprisonment for such an offender is manifestly excessive. Making child exploitation material under s 228C(1) is more serious than possession, and a sentence of two years imprisonment for filming a family member on five occasions is within range even for a first offender with strong mitigating factors.
