In cases of repetitive sexual offending of similar character, a charge particularised merely as 'the first occasion' of a particular act is insufficient where the complainant's evidence does not distinguish that occasion from other uncharged acts. However, particularisation by reference to a distinctive feature (such as payment of a specific sum of money) or temporal specificity (such as 'the last occasion, six to eight weeks before the police interview') may be sufficient. The totality principle may mean that quashing one count in a series of concurrent sentences does not warrant a reduction in the head sentence.
