The nature and importance of constitutional issues raised in a case stated, combined with the fact that the same constitutional issue has already been determined by a single judge in the Trial Division, constitutes special circumstances justifying removal of proceedings to the Court of Appeal under s 68(5) of the Supreme Court of Queensland Act 1991 (Qld). Where all facts have been found, it is expedient for all questions to be determined together in the Court of Appeal.
