A breach of a supervision order condition requiring a dangerous prisoner not to 'commit an indictable offence' under the Dangerous Prisoners (Sexual Offenders) Act 2003 (Qld) can be proved on the balance of probabilities in contravention proceedings without requiring a criminal conviction. The Briginshaw standard applies given the serious consequences of such a finding. The discontinuance of criminal proceedings does not preclude the Attorney-General from proving the commission of the offence in civil contravention proceedings.
