Where an offender's parole is suspended following the commission of new offences, the period served on the balance of the prior sentence cannot be declared as pre-sentence custody under s 159A of the Penalties and Sentences Act 1992 (Qld), because the offender is serving the prior sentence, not simply on remand. Parole eligibility after one-third of the sentence is an adequate recognition of a guilty plea. A cumulative sentence for offences committed while on parole in two jurisdictions is appropriate, and the totality of the resulting aggregate imprisonment must be assessed for manifest excess.
