Preliminary complaint evidence under s 4A of the Criminal Law (Sexual Offences) Act 1978 (Qld) is admissible only to the extent it relates to the specific offences charged; out-of-court statements about uncharged misconduct do not fall within s 4A. However, a deliberate forensic decision by defence counsel not to object to such evidence at trial will preclude the accused from raising the issue on appeal. A sentencing error involving a single sentence for multiple counts may be corrected by reopening under s 188 of the Penalties and Sentences Act 1992 (Qld) rather than by appeal.
