Where a certificate under s 124(1)(pa) of the Transport Operations (Road Use Management) Act 1995 (Qld) is inadmissible for want of proof of delegation by the Commissioner of Police, a speeding conviction may nonetheless be sustained by independent oral evidence from the operating officer and the technical officer who calibrated the device. Leave to appeal under s 118 of the District Court of Queensland Act 1967 (Qld) will be refused where the applicant has not demonstrated error amounting to a miscarriage of justice and the matter concerns minor traffic offences with modest penalties.
