The Garcia principle protecting wives who guarantee their husbands' debts extends to cases where the wife was merely indifferent to (rather than actively mistaken about) the terms of the transaction. A wife's general understanding of what a guarantee entails is insufficient to satisfy the lender's obligation; the wife must understand the purport and effect of the particular transaction including the amount of the debt, the term, and the risks peculiar to the investment. Indirect or prospective benefits through a family superannuation fund or reduced household tax burden do not preclude volunteer status. Commercial lenders requiring spousal guarantees must themselves explain the transaction or ensure a competent independent person has done so.
