For unprovoked knife attacks on strangers in public places causing life-threatening injuries, a head sentence in the range of six to seven years is the minimum, and a serious violent offence declaration is warranted. Intoxication is not a mitigating factor and is not relevant to whether a serious violent offence declaration should be made. The youth of an offender aged 18 does not significantly reduce the sentence for crimes of violence given amendments to s 9 of the Penalties and Sentences Act 1992 (Qld).
