Pre-judgment interest under s 47 of the Supreme Court Act 1995 (Qld) is available on damages assessed as the cost of repairs to damaged goods even where the plaintiff has not actually paid for the repairs, because such damages represent diminution in value measured by reference to repair costs, not an indemnity for costs incurred. The Admiralty rule that interest runs only from the date of payment of the repair bill does not constrain the statutory discretion. When assessing whether a formal offer to settle produces a result 'no less favourable' under UCPR r 360, the court must consider the costs component of the offer, including costs referable to claims subsequently abandoned.
