An electronic document on a deceased's computer that is in the form of a will and states testamentary intentions satisfies s 18(1) of the Succession Act 1981 (Qld). However, where the evidence shows the deceased printed and signed a paper version and described the paper document as her will, the electronic document is not intended to 'form' the will under s 18(2) — it is merely a step towards making the will in paper form. The distinction between a document embodying testamentary intentions and one intended to operate as a testamentary act applies equally to electronic documents.
