An amendment to particulars of loss at the commencement of trial that does not raise a new cause of action and does not cause real prejudice to the opposing party may be granted, even where the explanation for the late application is poor, provided the interests of justice are served. The Aon factors are to be applied with attention to the nature of the amendment, the stage of proceedings, prejudice, delay, and the adequacy of the explanation.
