Differences in co-offenders' roles in a joint criminal enterprise do not of themselves warrant disparate sentences where the roles are broadly comparable. However, marked disparity between co-offenders' sentences — including the difference between immediate imprisonment and a wholly suspended sentence — may be justified by differences in criminal history, subsequent offending, rehabilitation prospects, and lifestyle. An appellate court will not interfere merely because it might have followed a different course at first instance.
