Where the prosecution puts its case on the basis that the facts of one count are subsumed within another, the Crown cannot on appeal recharacterise the factual basis to justify separate punishment. Conviction on the subsumed count should be quashed, not merely made concurrent. A sentencing judge misinformed as to maximum penalties commits material error where the sentences imposed are of significant magnitude relative to the correct maximum.
