An application to change a plea of guilty, where refused by the trial judge and no trial has yet commenced, is unlikely to be certified as an interlocutory decision of sufficient importance under s 295(3)(b) of the Criminal Procedure Act 2009 (Vic), because the only proceeding that might be rendered unnecessary is a plea in mitigation. The Court of Appeal on review under s 296 will not examine the merits of proposed defences.
