A representation as to future conduct is not rendered misleading or deceptive under s 52 merely because the promised conduct does not eventuate; where the representor had genuine intention and means to perform at the time of making the representation, reasonable grounds are established. Section 51A's deemed lack of reasonable grounds does not assist proof against accessories under s 75B — the applicant must prove the accessory had actual knowledge of the falsity or lack of reasonable grounds. Not every deliberate breach of contract amounts to unconscionable conduct under s 51AC; the conduct must be evaluated in all the circumstances by reference to s 51AC(3) factors and must involve a high level of moral obloquy.
