A consent dismissal of a County Court proceeding challenging a termination of weekly payments under s 93CB(4) of the Accident Compensation Act 1985 determines the question of entitlement adversely to the worker and gives rise to an issue estoppel barring subsequent claims. A deterioration of a pre-existing employment injury does not constitute a fresh compensable injury under s 82(2C)(c) merely because the original injury arose in the course of employment — the worker must demonstrate that employment was a significant contributing factor to the deterioration itself. The repeal of s 93CB did not revive entitlements that had already terminated under that provision.
