Contested claims of compulsion or duress on a plea must be supported by admissible evidence proved on the balance of probabilities. Assertions from the bar table, including reading out a letter written by the offender, do not constitute evidence. Where the claimed compulsion arises from a drug debt owed to criminals as a result of illegal drug use, even if proved, such circumstances may not mitigate the seriousness of the offending.
