Service of approximately two-thirds of a non-parole period does not constitute an exceptional circumstance warranting entry of an acquittal rather than a retrial order. The test for dangerous driving requires directions conforming with R v De Montero, namely that the driving created 'a considerable risk of serious injury or death', not merely that it 'significantly increased the risk of harming others'.
