An appellate court will not disturb a trial judge's inferences from undisputed facts regarding the existence of a joint venture agreement where the trial judge had the advantage of observing witnesses and the inferences were reasonably open. Representations to third parties about beneficial ownership of property are of little relevance to the agreement between joint venturers inter se.
