A sentence of 3 years and 9 months for recklessly causing serious injury by glassing was manifestly excessive having regard to sentencing practices surveyed in Winch v The Queen [2010] VSCA 141, even for a case above the middle range of seriousness. An offender who pleads guilty is entitled to be sentenced in accordance with sentencing practices prevailing at the time of the plea, even if higher sentences may be considered appropriate in future.
